Palomino Pines - Acknowledgement of Risk and Liability Release

The undersigned USER, in consideration of the agreement of Palomino Pines LLC, PROVIDERS, to permit the USER to ride horses owned or furnished by PROVIDERS, hereby states, represents, and agrees as follows:

Representation as to physical condition: USER represents that his/her physical condition is such that horseback riding will pose no hazard to the health or well-being of the USER.

Acknowledgement and acceptance of risk: USER understands and acknowledges that risk, hazards and dangers inherent in horseback riding are both known and unknown, which could result in injury, death, illness or disease, and that such hazard may occur without anyone, including the providers of such horses, being at fault. Being fully aware of these risks and undersigned nonetheless desires to use the horse and hereby accepts any and all risks to the undersigned, to any third person or damage to the property of anyone, including the PROVIDERS of the tack and horses.

Release from liability: By reason of USER acknowledgement and acceptance of the risks of using PROVIDERS horses, and in consideration of the PROVIDERS wiliness to permit the USER to use such horses, despite exposure to liability claims from any resulting injury or damage. USER hereby knowingly and voluntarily releases forever discharges and agrees to hold harmless and indemnify the PROVIDER and their respective agents and employees, all other persons or entities affiliated with PROVIDERS, and the owners of the land upon which are related to, arise out of or are in any way connected with the horse provided by the PROVIDERS. Further, USER agrees, promises and covenants not to sue, assert, or otherwise maintain any claim against the PROVIDERS for injury, death, illness, or disease, or for property damage arising from the use of the Horses.

Attorney Fee, Indemnification: In the event of PROVIDERS are required to retain counsel and/or incur any expense in enforcing their rights under this agreement, whether by reason of claim against them, by USER or by a third person by reason of USER negligence, USER agrees to pay all such costs and attorney fees so incurred should provide be successful, in whole or part, in defending against such claims or in prosecuting their own claim(s) as the case may be. USER agreement to so hold harmless and indemnify PROVIDERS, and their respective agents, employees and any and all other person or entities associated there with from such costs, expenses and attorney fees, whether or not a suit is filed, judgement is rendered thereon, or appeal is taken there from.

Under Wisconsin Law, an Equine Professional is not liable for an injury to or death of a participant in Equine activities resulting from the inherent risks of Equine activities, pursuant to Section 895.481, Wisconsin Revised Statutes.

If USER is under the age of 18 years old, USERS parent or guardian must sign below: I have read the foregoing Acknowledge of risk and Liability release, and hereby affirm the representations made and agree to the terms of such instrument of behalf of the USER whose name and signature appears above.
